Our Commitment to Copyright Protection

This DMCA Policy explains our procedures for addressing copyright infringement claims and outlines the process for submitting a proper DMCA takedown notice if you believe content on our website infringes your copyright.

Understanding Copyright Infringement

Copyright infringement occurs when someone uses copyrighted material without permission from the copyright owner in a way that violates one or more of the copyright owner’s exclusive rights.

At Stella’s Home, we create original content and sometimes use images, quotes, or other materials that we believe fall under fair use or for which we have obtained proper permission. However, if you believe that content on our website infringes your copyright, we want to know about it.

Our Response to Valid DMCA Notices

Upon receiving a valid and complete DMCA takedown notice, we will:

Review the notice to ensure it meets all DMCA requirements. If the notice is incomplete, we may request additional information before proceeding.

Once we have a valid notice, we will promptly investigate the claim and take appropriate action, which may include removing or disabling access to the allegedly infringing material.

We will make a good faith effort to contact the person who posted the content to notify them of the takedown notice.

We reserve the right to remove content we believe in good faith infringes copyright, even if a formal DMCA notice has not been received.

Counter-Notification Procedure

If you believe that content you posted on Stella’s Home was removed or disabled by mistake or misidentification, you may file a counter-notification with our DMCA agent.

A counter-notification must include the following information:

Your physical or electronic signature, identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before removal, a statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification, your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the Northern District of Florida if your address is outside the United States), and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person.

Send your counter-notification to our DMCA agent at the contact information provided above, with “DMCA Counter-Notification” in the subject line.

Processing Counter-Notifications

Upon receiving a valid counter-notification, we will forward it to the party who submitted the original DMCA takedown notice.

If the original complainant does not file a court action seeking a court order against you within ten to fourteen business days of receiving the counter-notification, we may restore the removed content at our discretion.

Please note that filing a false counter-notification may result in legal consequences. We recommend consulting with an attorney if you are uncertain about your rights.

Repeat Infringer Policy

Stella’s Home maintains a policy of terminating, in appropriate circumstances, the accounts or access of users who are repeat infringers of copyright.

While we primarily create our own content, if we receive multiple valid copyright infringement notices regarding content from the same source or contributor, we reserve the right to take appropriate action, including removing all content from that source.

Misrepresentations and Penalties

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing or was removed or disabled by mistake or misidentification may be subject to liability.

Before submitting a DMCA notice or counter-notification, please ensure that you have carefully evaluated whether the use in question constitutes infringement or whether it may be protected by fair use or another exception to copyright.

Fair Use Consideration

Stella’s Home is an educational and informational website focused on home improvement and design. Some content on our site may include copyrighted material used under the fair use doctrine.

Fair use is a legal doctrine that permits limited use of copyrighted material without requiring permission from the copyright holder. Factors considered in fair use analysis include the purpose and character of the use, the nature of the copyrighted work, the amount used in relation to the whole, and the effect on the potential market for the original work.

We strive to use copyrighted materials responsibly and in accordance with fair use principles. However, if you believe we have not properly applied fair use, please contact us with your concerns.
